1. Call meeting to order.
Board President Kent Watson Called the meeting to order at 3:00 pm.

2. Pledge of Allegiance.

3. Discussion and possible action on the Minutes from the January 3, 2008 Regular Board Meeting.
A motion was made by Pete Brien, second by Dale Johnson to accept the Minutes from the January 3,
2008 Board Meeting as presented. The motion carried unanimously.

4. Review and Authorization of payments made for services rendered January 2008 and February 2008. A
motion was made by Tom McDonald, second by Pete Brien to accept the payments made in January
2008 and February 2008. The motion carried unanimously.

5. Public Hearing for the purpose of taking Public comment on the following Historic Use Permit Applications:

A. Six wells for The Vince Court Farm. The wells are located South of Cotrone Dix Lane on the East and West sides of Hwy 50, Bryan, TX for a total of 680 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

B. One well for Tony Varisco III located at the Northeast intersection of Hwy 50 and Sandy Point Road, Bryan, TX for a total of 106 acre/feet per year for Agricultural Irrigation. The well is in the Brazos River Alluvium Aquifer.

C. Six wells for Tony Varisco III. The wells are located West of Hwy 50 and South of Wallin Road Bryan, TX for a total of 554 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

D. One well for The Salvato Farm located at the Northeast intersection of Hwy 50 and Sandy Point Road, Bryan, TX for a total amount of 158 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

E. Two wells for The Nunn Place. The wells are located West of Hwy 50, East of the Brazos River, and North of Fazzino Road, Bryan, TX for a total of 160 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

F. Three wells for Blackland Farms. The wells are located East of Hwy 50 and South of Sims Lane, Bryan, TX for a total of 292 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

G. Three wells for Joe C. & Josie Patranella FLP. The wells are located at the Northwest intersection of Hwy 50 and Fazzino Road, Bryan, TX for a total of 269.58 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

H. Two wells for The Lee Court Farm. The wells are located West of Hwy 50 and South of Mooring Lane, Bryan, TX for a total of 163 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

I. Two wells for The Simms Place. Well # 1 is located at the Northeast intersection of Hwy 50 and Sims Lane, and Well # 2 is located at the Southeast intersection of Hwy 50 and Sims Lane, Bryan, TX for a total of 221acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

J. Two wells for The Bonano-Fachorn Farm. The wells are located at the Northwest intersection of Steele Store Road and Wallin Road, Bryan, TX for a total of 180.80 acre/feet per year for Agricultural Irrigation. The wells are in the Brazos River Alluvium Aquifer.

K. Three wells for The Bonano-Scarcella Farm. Well # 1 is located at the Southwest intersection of Steele Store Road and Wallin Road, and Well # 2 and Well # 3 are located East of Hwy 50, (across from well # 1), North of the Gin, Bryan, TX for a total of 296 acre/feet per Agricultural Irrigation, The wells are in the Brazos River Alluvium Aquifer.

Due to a problem with the agenda item description no action was taken on the Historic Use Permit Applications.

6. Discussion and possible action on the following Operating Permit Applications:
A. Three wells for Miramont Management Company, L.L.C., Miramont Country Club. The wells are located at 1 Miramont Boulevard, Bryan, TX for a total of 1,034.1 acre/feet per year for Irrigation of Golf Course and Common Areas. The wells are in the Sparta Aquifer.

B. Three wells for The City of Franklin. Well # 2 is located at 407 North Center Street, well # 3 is located in the City Park on City Park Blvd, and well # 4 is located at the end of North Calvert Street, Franklin, TX for a total of 339 acre/feet per year for Public Water Supply. The wells are in the Simsboro Aquifer.

Kent Watson presented the facts concerning the Operating Permit Applications. A motion was made by Pete Brien, second by Dave Coleman to postpone a decision on the Operating Permit Applications until the aquifer availability study from LGB-Guyton is presented. The motion carried unanimously.

7. Discussion and possible action on the following Drilling/Operating Permit Applications:

A. One well for Jed Waltemathe/Circle D Nurseries will be located at 915 Scoffield Drive, College Station, TX for a total of 1.34 acre/feet per year for Agricultural Irrigation. The well will be located in the Yegua Aquifer. Jed Waltemathe/Circle D Nurseries requested a Drilling/Operating Permit for one (1) well located at 2012 Finfeather Road, College Station, TX for the amount of 1.34 acre/feet per year for Agricultural Irrigation. The well will be located in the Yegua Aquifer.

B. Two wells for Schoeneman Broiler Farms. The wells will be located at 4047 Leamon Lane, Franklin, TX for a total of 70 acre/feet per year for Poultry Houses. The wells will be located in the Queen City Aquifer. Schoeneman Broiler Farms requested a Drilling/Operating Permit for two (2) wells located at 4047 Leamon Lane, Franklin, TX for the amount of 70 acre/feet per year for Poultry Houses. The wells will be located in the Queen City Aquifer.

Kent Watson presented the facts concerning the Drilling/Operating Permit Applications. A motion was made by Dale Johnson, second by Carl Cotropia to approve the Drilling/Operating Permit Applications as presented. The motion carried unanimously.

8. Discussion and possible action on awarding a contract for roofing repairs.
Ralph Crum presented three bids from roofing contractors to the Board of Directors which included United Roofing and Sheetmetal, Inc. at $9,696.00, Brazos Urethane, Inc. at $16,590.00, and C R Systems, Inc. at $16,829.00 for roofing repairs. Ralph Crum recommended the Duro-Last System from United Roofing and Sheetmetal Inc. because it has the longest warranty at 15 years, The Duro-Last System is maintence free, it is the most economical option at $9,696.00, and within our budget. A motion was made by Pete Brien, second by Steve Lazarus to approve the roofing repairs to United Roofing and Sheetmetal, Inc. for the price of $9,696.00 as presented. The motion carried unanimously.

9. Discussion and possible action on agreement with Sabrina Brown for legislative services.
Bill Riley presented the contract from Sabrina Brown for providing legislation services for the Brazos Valley Groundwater Conservation District. A motion was made by Tom McDonald, second by Carl Cotropia to accept the contract with Sabrina Brown for continued legislative services. The motion carried unanimously.

10. General Managers Report
The Districts financial reports were presented to the Board.

11. Legal Report
Monique Norman had nothing to report at this time.

12. Hear Visitors.
Howard Dehart, of Twin Creek Water Supply Company asked if the Board was aware of a rumored new requirement by the state that would require payment of additional fees for each well they operated. Additionally, if going over a set amount of water they would be fined by the State. The Board assured Mr. Dehart that this was not a District requirement, nor were any Board Members aware of any plans to implement such a process.

13. Adjourn.

The Board of Directors may meet in closed session, pursuant to the Texas Open Meetings Act, Texas Government Code §§ 551.071-551.076, to:
(1) consult with attorney
(2) deliberate regarding the purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(3) deliberate a negotiated contract for a prospective gift or donation to the District if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(4) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a Board member or District employee;
(5) to receive information from employees or question employees, but not deliberate public business or agency policy that affects public business; and
(6) to deliberate the deployment or specific occasions for implementation of security personnel or devices.

The Board may also meet in open session on these matters as required by the Texas Open Meetings Act, Texas Government Code § 551.102.
