1. Call meeting to order.

Board President Kent Watson called the meeting to order at 3:00 PM.

2. Pledge of Allegiance.

3. Discussion and possible action on the Minutes from the April 10th, 2008 Regular Board Meeting.

A motion was made by Wayne Wilson, and seconded by Dave Colman to accept the Minutes from the

April 10th, 2008 Board Meeting as presented. The motion carried unanimously.

4. Review and Authorization of payments made for services rendered during April 2008.

Authorization of payments and Services report will be available at the July Board Meeting.

5. Public Hearing on the following Drilling/Operating Permit Applications:

6.Four wells for Andy Ngo, located at 9312 Cook Road, Bremond, TX. Request is for a total of 100 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

Andy Ngo requested a Drilling/Operating Permit for (4) four wells located at 9312 Cook Rd. Bremond, TX., for a total of 100 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

7.Three wells for Tom Nguyen, located at 9312 Cook Road, Bremond, TX. Request is for a total of 75 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

Tom Nguyen requested a Drilling/Operating Permit for (3) three wells located at 9312 Cook Rd. Bremond, TX., for a total of 75 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

8.Three wells for Christine Nguyen, located at 9312 Cook Road, Bremond, TX. Request is for a total of 75 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

Christine Nguyen requested a Drilling/Operating Permit for (3) three wells located at 9312 Cook Rd.

Bremond, TX., for a total of 75 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

9.Four wells for Phap Nguyen, located at 9312 Cook Road, Bremond, TX. Request is for a total of 100 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

Phap Nguyen requested a Drilling/Operating Permit for (4) four wells located at 9312 Cook Rd. Bremond, TX., for a total of 100 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

10.Three wells for Dung Vu, located at 9312 Cook Road, Bremond, TX. Request is for a total of 75 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

Dung Vu requested a Drilling/Operating Permit for (3) three wells located at 9312 Cook Rd. Bremond, TX., for a total of 75 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

11.Two wells for David and Janie Burnett of Robertson County Poultry, LLC. The wells will be located South East of 1953 Marris Lane, Franklin, TX. Request is for a total of 68 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

12.Three wells for David and Janie Burnett of Robertson County Poultry II, LLC. The wells will be located South of 1953 Marris Lane, Franklin, TX. Request is for a total of 102 acre-feet per year for commercial use. The wells will produce from the Hooper Aquifer.

David and Janie Burnett of Robertson County Poultry II, LLC., request a Drilling/Operating permit for (3) three wells located South of 1953 Marris Lane, Franklin, TX., for a total of 102 acre-feet per year for commercial use, (Poultry Operation). The wells will produce from the Hooper Aquifer.

13.One well for Energy Transfer, located at 10892 James Cemetery Road, Franklin, TX. Request is for a total of 3 acre-feet per year for industrial use. The well will produce from the Queen City Aquifer.

Energy Transfer requested a Drilling/Operating Permit for (1) well located at 10892 James Cemetery Rd. Franklin, TX., for a total of 3 acre-feet per year for industrial use, (Wash equipment and supply water to a bathroom). The well will produce from the Queen City Aquifer.

14. Discussion and possible action on the above Drilling/Operating Permit Applications.

President Kent Watson presented the facts concerning the Drilling/Operating Permit Applications. President Watson asked Assistant General Manager Crum if he knew how much acreage would be utilized for the poultry operation, stating his concern for appropriate spacing between wells. Crum replied that the poultry operation, would operate on a 430 acre tract of land. The individual family operations and their wells, would be constructed as far away from each other as possible. A motion was made by Pete Brien, and seconded by Wayne Wilson to approve the Drilling/Operating Permit Applications as presented. The motion passed unanimously.

15. Update on Groundwater Management Area 12 & 14 progress for determining Desired Future Conditions of aquifers.
Assistant General Manager Ralph Crum updated the Board on the details of a request made by Groundwater Management Area 14 to assist with funding of a Desired Future Conditions study. The cost would be shared equally by Groundwater Districts that make up GMA 14. The amount requested of Brazos Valley Groundwater Conservation District is $4,475.00.

16. Discussion and possible action on a request from Groundwater Management Area 14 to participate in a study to determine the Desired Future Conditions for aquifers within GMA 14.
President Kent Watson suggested that any discussion and possible action be tabled until a scope of services is Provided by GMA 14. A motion was made by Wayne Wilson to table the discussion until the next Board Meeting in July. Judge Tom McDonald seconded. The motion passed unanimously.

17. General Managers Report.
Assistant General Manager Ralph Crum, filling in for General Manager Bill Riley advised the Board that due to the circumstances related to Mr. Riley’s injury, there would not be a June Board Meeting. The next Board meeting would be held in July, after the Holiday, on a date to be determined.

18. Legal Report.

Attorney Monique Norman had nothing to report.

19. Hear visitors.

No visitors addressed the Board.

20. Adjourn.
A motion was made by Dave Coleman, seconded by Pete Brien to adjorn the meeting at 4:10 PM. The motion carried unanimously.

The Board of Directors may meet in closed session, pursuant to the Texas Open Meetings Act, Texas Government Code §§ 551.071-551.076, to:
(1) consult with attorney
(2) deliberate regarding the purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(3) deliberate a negotiated contract for a prospective gift or donation to the District if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(4) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a Board member or District employee;
(5) to receive information from employees or question employees, but not deliberate public business or agency policy that affects public business; and
(6) to deliberate the deployment or specific occasions for implementation of security personnel or devices.

The Board may also meet in open session on these matters as required by the Texas Open Meetings Act, Texas Government Code § 551.102.
