The Brazos Valley Groundwater Conservation District will be holding a contested cased hearing on the permit applications of Dr. Cliff A Skiles, Jr. D.V.M and the CA Skiles Family Partnership, Ltd, to pump an additional 8300 acre-feet of groundwater annually from the Simsboro Aquifer. In addition to the application to pump additional groundwater, the District will also consider possible amendment or revocation of Dr. Cliff A Skiles, Jr. D.V.M and the CA Skiles Family Partnership, Ltd’s historic use permits for 20,481 acre-feet /year in the Simsboro Aquifer and 28,781 acre-feet /year in the Brazos River Alluvium Aquifer, as part of the contested case hearing.
The wells are used to irrigate 8509 acres of land and are located at Brazos Barton Farms, 4026 North FM 1644, Hearne, Texas, and at Goodland/Harlan Farms, North of FM 485, West of Hwy 6 extending east of the Brazos River, Hearne, Texas.
The Brazos Valley Groundwater Conservation District’s staff has recommended denial of the application and possible amendment of the historic use permits.
The Preliminary Hearing for this contested case hearing will be on Thursday, September 4, 2008 at 1:00 pm. All persons or entities that want to become a party in the contested case hearing must submit written notice to the District at least five (5) calendar days prior to the hearing on September 4 and attend that hearing. Participation in the hearing is limited to persons and entities who have a personable justiciable interest related to a legal right, duty, privilege, power, or economic interest that within the District’s regulatory authority and affected by the permit application and amendments to the historic permits, not including persons who have an interest common to members of the public.
The contested case hearing will be held pursuant to Chapter 36 of the Texas Water Code and the District’s Rules, which can be found at www.brazosvalleygcd.org. The issues raised in the contested case hearing will center around the requirements being met of Sections 7 and 8 of the District’s Rules and Sections 36.113-36.116 of the Texas Water Code.

The Board of Directors may meet in closed session, pursuant to the Texas Open Meetings Act, Texas Government Code §§ 551.071-551.076, to:
(1) consult with attorney
(2) deliberate regarding the purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(3) deliberate a negotiated contract for a prospective gift or donation to the District if deliberation in an open meeting would have a detrimental effect on the position of the District in negotiations with a third person;
(4) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a Board member or District employee;
(5) to receive information from employees or question employees, but not deliberate public business or agency policy that affects public business; and
(6) to deliberate the deployment or specific occasions for implementation of security personnel or devices.
The Board may also meet in open session on these matters as required by the Texas Open Meetings Act, Texas Government Code § 551.102.
